GENERAL TERMS AND CONDITIONS OF SALE
Preamble
Blumind Design, under the brand 3DMAKER.SPACE, operates the website www.3dmaker.space, enabling individual and professional buyers to purchase the goods and services offered for sale. By using this service, the buyer agrees to be bound by these Terms and Conditions of Sale (TCS) without restriction or reservation.
1. Scope of Application
These Terms and Conditions of Sale apply to all sales conducted by Blumind Design. They are accessible via a hyperlink on the website’s homepage. Placing an order implies full and unconditional acceptance of the TCS by the buyer.
2. Pricing
Product and service prices are indicated in euros (€), excluding taxes (VAT not applicable under Article 293B of the French General Tax Code). Unless otherwise specified, shipping costs are additional and indicated at the time of order confirmation. Prices may be modified at any time, particularly in response to tax or economic changes. Invoices are issued based on the pricing effective on the order date.
3. Quotations
Quotations are provided free of charge and are valid for thirty (30) days. After this period, terms may be revised. A quotation accepted and signed by the client shall constitute a Purchase Order binding both parties.
4. Right of Withdrawal
In accordance with applicable law, the buyer has a period of fourteen (14) days from receipt of the goods to exercise their right of withdrawal without having to provide any reason or pay penalties.
To exercise this right, the buyer must send a written notice via email (contact@3dmaker.space) or postal mail.
In the event of withdrawal within the specified period, only the price of the goods and the initial shipping costs will be reimbursed. Return shipping costs are the responsibility of the buyer. Returned products must be in their original condition, complete (packaging, accessories, manuals), and properly packed.
5. Returns Outside Withdrawal Period
No returns will be accepted without prior written agreement from Blumind Design, except in cases falling under the right of withdrawal.
6. Delivery
Goods are dispatched upon full payment of the invoice. Any payment delay will automatically postpone delivery.
Delivery times are indicative only and non-binding. A delay does not entitle the buyer to cancel the sale, refuse delivery, or claim penalties, deductions, or compensation.
Goods travel at the buyer’s risk, and it is the buyer’s responsibility to verify the condition of the goods upon receipt and to raise any claims within eight (8) days.
7. Force Majeure
Blumind Design cannot be held liable for failure to perform obligations due to events of force majeure, including but not limited to strikes, transport disruptions, shortages of materials or energy, and any unforeseen and irresistible event as defined by Article 1218 of the French Civil Code.
8. Payment
Orders must be paid for in advance via bank transfer or through the online payment system provided on the website. Unless otherwise specified, invoices are payable immediately upon receipt and no later than three (3) business days after issue.
9. Late Payment
In the event of late payment, late fees equal to three (3) times the legal interest rate will apply from the day following the due date shown on the invoice.
If a buyer has previously failed to comply with payment obligations, Blumind Design reserves the right to refuse subsequent sales.
10. Termination Clause
If fifteen (15) days after formal notice the buyer has not paid the outstanding sums, the sale shall be automatically terminated without prejudice to any damages that may be claimed by Blumind Design.
11. Retention of Ownership
Ownership of the goods sold remains with Blumind Design until full payment of the price, including any interest. However, the buyer assumes the risk for the goods once they are handed over to the carrier.
12. Warranty
The warranty is strictly limited to repairing or replacing goods that are defective or non-compliant, excluding any other form of compensation.
13. Liability
Blumind Design’s liability, if engaged, is limited to the amount of the goods or services concerned and excludes any indirect damages or consequential losses.
14. Confidentiality and Intellectual Property Protection
All elements comprising the website www.3dmaker.space (including texts, images, graphics, logos, products, concepts) are protected by the provisions of the Intellectual Property Code and are the exclusive property of the company Blumind Design, unless otherwise stated.
Any reproduction, representation, modification, distribution, or exploitation, whether total or partial, of any of these elements without the prior written authorization of the rights holder is strictly prohibited and may constitute an infringement punishable under articles L.335-2 et seq. of the Intellectual Property Code.
The client undertakes to keep strictly confidential all non-public information, whether technical, commercial, or otherwise, that may be communicated to them within the framework of the execution of these General Terms and Conditions of Sale (GTC), and not to disclose them to third parties without the prior written consent of the company Blumind Design.
Any violation of this confidentiality obligation may engage the client's liability and give rise to appropriate legal actions, notably on the grounds of civil liability (article 1240 of the Civil Code), unfair competition, or economic parasitism, as the case may be.
15. Personal Data Protection
In accordance with Regulation (EU) 2016/679 of April 27, 2016 (GDPR) and amended Law No. 78-17 of January 6, 1978, known as the "Data Protection Act," the buyer has the right to access, rectify, erase, restrict the processing of, object to the processing of their personal data, as well as the right to data portability.
They can exercise these rights by sending their request to contact@3dmaker.space, providing proof of their identity.
The buyer also has the right to lodge a complaint with the National Commission for Information Technology and Liberties (CNIL) if they believe their rights are not being respected.
16. Governing Law and Jurisdiction
These TCS are governed by French law.
In the event of a dispute, and after attempting amicable resolution, exclusive jurisdiction is granted to the courts of Paris.
